Please read these terms carefully before using SuchiDesk. By accessing or using our platform, you agree to be bound by these terms.
Acceptance of Terms
By creating an account or using SuchiDesk, you agree to comply with these Terms of Service and our Privacy Policy. If you do not agree, you may not use our services.
User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials. You agree not to use the platform for any illegal or unauthorized purpose.
Communications
By using the service, you agree to receive system-generated emails regarding your account, transactions, and service updates. These communications are an integral part of the service.
User Eligibility
You must be at least 18 years of age and legally capable of entering into a binding agreement to use SuchiDesk. By registering, you represent that you are authorized to act on behalf of your business entity.
Subscription & Payments
SuchiDesk offers subscription-based services. Fees are billed in advance on a monthly basis. You may cancel your subscription at any time, but refunds are not provided for partial months.
Recurring Payments & Auto-Debit
By subscribing to SuchiDesk, you authorize Razorpay to charge your registered payment method on a recurring monthly basis via an e-mandate (auto-debit). Key details: (a) Billing occurs on the 1st of every month. (b) A pre-debit notification will be sent 24 hours before each recurring charge, as required by the Reserve Bank of India (RBI). (c) The first payment requires 3D Secure (OTP) authentication to set up the mandate. (d) In case of payment failure, we will retry the charge on day 3 and day 7. If all attempts fail, your account may be suspended. (e) You may cancel the mandate at any time by contacting support@suchidesk.in.
Termination
We reserve the right to suspend or terminate your account if you violate these terms or engage in activity that harms the platform or other users.
Limitation of Liability
SuchiDesk is provided 'as is'. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service.
Intellectual Property
All content, features, and functionality of SuchiDesk β including but not limited to text, graphics, logos, software, and design β are the exclusive property of SuchiDesk and are protected under applicable Indian intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the platform without prior written consent.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat, India. Both parties agree to first attempt resolution through good-faith negotiation before pursuing legal remedies.
Anti-Spam & Prohibited Use
Zero-tolerance policy: Spam or unsolicited WhatsApp messages will result in immediate account suspension.
SuchiDesk has a zero-tolerance policy for spam and unsolicited communications. By using our platform, you (and any business/Vendor using SuchiDesk) agree to the following: (a) You must NOT use SuchiDesk to send unsolicited, bulk, or non-transactional messages to any individual via WhatsApp, Email, or SMS. (b) All WhatsApp messages sent through our platform must be transactional in nature (e.g., appointment confirmations, OTPs, service updates) and only to recipients who have given their prior explicit consent. (c) You are strictly prohibited from using SuchiDesk to send marketing or promotional messages without the recipient's opt-in consent. Violation of this clause may result in immediate account suspension and reporting to Meta Platforms, Inc.
Vendor WhatsApp Business Account (WABA) Compliance
If you are a business ("Vendor") using SuchiDesk to send WhatsApp messages to your customers, the following terms apply: (a) Opt-In Responsibility: You, the Vendor, are solely responsible for obtaining the initial, explicit opt-in consent from your customers before sending them any WhatsApp messages via SuchiDesk. SuchiDesk does not obtain this consent on your behalf. (b) WhatsApp Business Terms: You must comply with the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy, and the WhatsApp Messaging Guidelines at all times. (c) Meta Ban Liability: SuchiDesk is not liable if your WhatsApp Business Account (WABA) is banned, restricted, or penalised by Meta Platforms, Inc. due to your violation of Meta's policies. Any such ban is the sole responsibility of the Vendor. (d) Template Approvals: Meta's message template approval process is independent of SuchiDesk. We are not responsible for the rejection of any message template by Meta. (e) Prohibited Data via WhatsApp: You must not use SuchiDesk to send, request, or share full-length payment card numbers, financial account numbers, Aadhaar numbers, PAN numbers, or other government-issued personal identification numbers via WhatsApp. You must not transmit health-related data or medical records via WhatsApp if applicable regulations prohibit such transmission on non-compliant systems. (f) Human Agent Escalation: If you use automated messaging within WhatsApp's 24-hour customer service window, you must maintain at least one accessible human agent escalation path (e.g., phone number, email, or web support) so that customers can reach a human representative when needed. (g) Opt-In Records: You must maintain verifiable records of explicit consent obtained from each customer you contact via WhatsApp and must provide such records to SuchiDesk or Meta upon request.
WhatsApp Data Handling & Messaging Compliance
These requirements are derived from the WhatsApp Business Messaging Policy and are binding on all users of SuchiDesk's WhatsApp features.
In addition to the above, all users and vendors must observe the following WhatsApp-specific data and compliance requirements, which are derived directly from the WhatsApp Business Messaging Policy: (a) Prohibited Identifiers: You must not request, share, or forward full-length individual payment card numbers, financial account numbers, personal ID card numbers (e.g., Aadhaar, PAN), passport numbers, or other sensitive government-issued identifiers via WhatsApp. (b) No Health Data: Do not use WhatsApp to send or request health-related information, medical records, or telemedicine services if applicable regulations require heightened security standards for such data. (c) No Cross-Customer Data Sharing: You must not share or forward information from one customer's WhatsApp conversation with any other customer. (d) No Financial Solicitation: You must not use WhatsApp to solicit financial information or conduct transactions that violate applicable payment regulations. (e) Quality Experience Standard: You must maintain a positive quality rating on WhatsApp by respecting opt-out requests immediately, avoiding misleading messages, and not confusing, deceiving, or surprising people with your communications. (f) Meta Policy Updates: WhatsApp may update its messaging policies at any time. By continuing to use SuchiDesk's WhatsApp features, you agree to comply with any updated WhatsApp Business Messaging Policy. Failure to comply may result in your WhatsApp Business Account being restricted or banned by Meta.
OTP Security & WhatsApp Authentication
SuchiDesk uses One-Time Passwords (OTPs) delivered via Email and WhatsApp for authentication purposes. The following terms govern this process: (a) User-Initiated Only: OTPs are sent exclusively upon a direct, explicit action by the user, such as initiating account registration, logging in, or confirming a transaction. We do not send OTPs proactively. (b) Industry-Standard Encryption: All OTP generation and transmission processes use industry-standard cryptographic methods. OTPs are time-limited (valid for 10 minutes) and single-use. (c) Non-Storage: OTP codes are not stored in our database after use or expiry. (d) User Responsibility: You are responsible for keeping your OTP confidential. SuchiDesk will never ask for your OTP via phone call, email, or any other channel. If you receive an OTP you did not request, please contact us immediately at support@suchidesk.in.
